1. Introduction and definitions
1.1. These GENERAL TERMS AND CONDITIONS govern the relationship between ” EKON 91″ OOD, UIC 117008223, with registered office and management address: Ruse, Western Industrial Zone, 11 Kapitan Raycho Nikolov Str. (hereinafter referred to as ” EKON 91″, “we”, “us”, “Seller”) and the users of the e-shop fortunapaints.bg (hereinafter referred to as the “Site”).
1.2. For the purposes of these General Terms and Conditions:
- “Consumer” is any natural person who, as an end user, acquires the goods offered by ” EKON 91″ Ltd. for personal needs or any natural or legal person who carries out commercial or professional activity.
- “Distance Contract” is a contract concluded between ” EKON 91″ Ltd. and the User, without the simultaneous physical presence of both parties, through the exclusive use of means of distance communication (internet, e-mail, etc.) until the conclusion of the contract, including at the time of its conclusion.
- “Goods” are all products offered for sale through the Site by ” EKON 91″ Ltd.
2. Acceptance of the General Terms and Conditions
2.1. Access to and use of the Site, as well as ordering goods through it, implies full acceptance of these General Terms and Conditions by the User.
2.2. By clicking on any object, link or button located on the pages of fortunapaints.bg (except for the link to these General Terms and Conditions), the User agrees, fully accepts and undertakes to comply with these General Terms and Conditions.
2.3. When the User does not agree with the general terms and conditions, he is obliged to immediately cease using the Site.
2.4. ” EKON 91″ Ltd. is not responsible if the User has not familiarized himself with these General Terms and Conditions.
2.5. ” EKON 91″ Ltd. reserves the right to change, delete and edit the General Terms and Conditions at any time, and the relevant changes will be published on the Site and will enter into force from the moment of their publication. The User undertakes to periodically check for updates to the General Terms and Conditions.

4. Registration and personal data
4.1. For the purposes of using the Site at fortunapaints.bg, the User agrees and declares that he will provide true, accurate, current and complete information when filling out the registration form or when placing an order without registration.
4.2. In case the User provides false, inaccurate, outdated or incomplete information, ” EKON 91″ Ltd. has the right to:
- Close and/or delete information about his/her postal address;
- Deny further access to some or all of its services;
- It is not responsible for an incorrectly and/or inaccurately executed order placed in connection with the information received from the User.
4.3. Upon registration, the User creates a username and password, which are strictly personal and must not be shared with third parties. The User bears full responsibility for all actions performed with his/her profile and is obliged to immediately notify ” EKON 91″ Ltd. in the event of unauthorized access.
4.4. The processing of Users’ personal data is carried out in accordance with the Personal Data Protection Policy of ” EKON 91″ Ltd., published on the Site.
5. Intellectual property
5.1. All texts, images, graphics, logos, sounds, software and other materials on the Site are the property of ” EKON 91″ Ltd. or are used with the permission of the respective rights holders and are protected by copyright and other laws for the protection of intellectual property.
5.2. ” EKON 91″ Ltd. grants the Users the right to use all services listed on the Site only for personal, non-profit purposes and provided that the copyrights of ” EKON 91″ Ltd. or third parties directly or indirectly related to the materials on the Site are not violated.
5.3. It is expressly prohibited for the materials published on this Site to be copied, publicly distributed or distributed for any purpose by Users. The use of the materials published on this Internet Site on other sites is prohibited and violators are subject to sanctions according to the provisions set forth in the Law for the Protection of Copyright and Related Rights.
5.4. ” EKON 91″ Ltd. reserves the right to assign the rights to publish materials and other information published on the Site to third parties upon additional written agreement.
5.5. When purchasing a product that is subject to copyright and/or patent rights, ” EKON 91″ Ltd. does not grant any additional rights for use and distribution of the product.
6. Products and prices
6.1. Information about the goods on the Site is divided into types of groups and subgroups. The page for each item listed on the Site provides information about the price, the main characteristics of the goods and additional information.
6.2. ” EKON 91″ Ltd. reserves the right to publish names, models and other information about products in English when:
- There is a risk that valuable information about the characteristics of the product will be lost during translation;
- There is no generally accepted unambiguous terminology in the Bulgarian language.
6.3. All prices listed on the Site are in Bulgarian leva and include VAT.
6.4. ” EKON 91″ Ltd. has the right to change the prices indicated on the Site at its discretion, at any time and without being obliged to notify the Users in advance.
6.5. The User is obliged to pay the price that was indicated on the Site at the time of placing the order, regardless of whether it is lower or higher than the updated price.
6.6. In the event of technical errors in the information published on the Site, as a result of which the order cannot be fulfilled, ” EKON 91″ Ltd. has the right to refuse to fulfill the order and does not owe any other compensation to the User, except for a refund of the amounts paid and/or deposited by the User for the canceled order, if any.
7. Order and conclusion of a contract
7.1. The User has the right to order all goods and services listed on the Site at fortunapaints.com. When placing the order, the User has the right to choose the type of goods and their quantity, the method and terms of delivery, according to the options offered on the Site.
7.2. At any time before the final confirmation of the order by filling out the online purchase form, the User has the right to make changes to the goods and services he has selected.
7.3. The order is considered to be finally placed after receiving confirmation of the order, following the instructions specified on the Site.
7.4. The User is informed and declares his consent that the order he has placed may undergo changes, which ” EKON 91″ Ltd. undertakes to notify the User at the email and/or contact telephone number provided by him and/or in another appropriate manner until the moment of receiving confirmation of the final sending of the confirmed order to the User’s address.
7.5. When placing an order on the Site, the User enters into contractual relations with ” EKON 91″ Ltd., concerning the specific order and regulated by these General Terms and Conditions.
7.6. In case of inability to fulfill the order due to exhaustion of the goods or other objective reasons, ” EKON 91″ Ltd. will immediately notify the User and offer a replacement product or refund of the amount paid.
8. Delivery
8.1. Delivery is made to the User’s address, with ” EKON 91″ Ltd. and the partner courier company taking on the responsibility of transporting the product to the front door of the building, which is specified in the order.
8.2. The delivery price (when an express order is selected) is specified with the partner courier company depending on the User’s location and is confirmed by the User after a phone call from an employee of ” EKON 91″ Ltd. This price is not automatically added to the order value.
8.3. Delivery is made within the period specified upon confirmation of the order. In case of a delay in delivery, ” EKON 91″ Ltd. will notify the User and offer a new delivery period or cancellation of the order.
8.4. The risk of damage or loss of the goods passes to the Consumer at the moment of acceptance of the goods by the Consumer or by a third party indicated by him, other than the carrier.
8.5. Detailed information about delivery can be found in the “Delivery” section of the Site.
9. Inspection of the goods upon delivery
9.1. Upon delivery, the goods should be carefully inspected by the User and/or a person authorized by him.
9.2. If external visible defects are found – upon inspection, any damage, tears, stains and other damage found upon delivery, the User should sign a damage report in the presence of the courier immediately and notify an employee of ” EKON 91″ Ltd. at tel.: +359 82 594 914.
9.3. Upon acceptance of the shipment by the User without any comments, any and all claims for external visible defects are unfounded and as such should not be satisfied.
9.4. In the event that a damage report is not prepared and signed in the presence of the courier upon receipt of the shipment and/or an employee of ” EKON 91″ Ltd. is not immediately notified, the User loses his right to bring the detected external visible defects into compliance with the sales contract.
9.5. When the delivered goods clearly do not correspond to those requested for purchase by the User and this can be established upon a simple inspection of the delivered goods, the User has the right to request that the delivered goods be replaced with goods corresponding to the application for purchase of goods made by him within 24 hours of notifying an employee of ” EKON 91″ OOD of such a request at tel: +359 82 594 920.
10. Payment methods
10.1. When making a cash payment for the ordered goods and services, the User undertakes to deposit at the time of delivery to ” EKON 91″ Ltd. or its representative/subcontractor performing the delivery, the full value of the delivered goods according to the confirmed order.
10.2. When paying by bank transfer, the User deposits an amount equal to the value of the delivered goods according to the confirmed order into the bank account of ” EKON 91″ OOD, indicated in the generated invoice. The delivery of the ordered goods and services is carried out only after the deposit is confirmed as received and the bank account is credited with the corresponding amount.
10.3. When paying by card online, the User should use a valid debit or credit card and enter the necessary data in the secure payment portal.
10.4. All payments via electronic banking or cards are made through secure communication channels.
11. Right to withdraw from the contract and return goods
11.1. The consumer has the right to refuse and request the return of the goods ordered and purchased by him within 14 (fourteen) days of receiving the goods at the delivery address, provided that the packaging is intact (the packaging of the shipment can be opened), in full equipment and the goods are in the form in which they were received with the accompanying documentation (invoice and warranty card) and under the conditions of Art. 55 of the Consumer Protection Act.
11.2. The withdrawal period is 14 days from the date of receipt of the goods. To exercise the right of withdrawal, the User must notify ” EKON 91″ OOD of his decision to withdraw from the contract by a letter sent by post, containing the name, address and telephone number of the User. The courier shipment back to the factory is at the expense of the User.
11.3. The User may use a standard withdrawal form, which can be obtained upon request at online@fortunapaints.bg, but this is not mandatory. In order to comply with the withdrawal period, it is sufficient for the User to send his/her message regarding the exercise of the right of withdrawal before the expiry of the withdrawal period.
11.4. In the event that within 14 (fourteen) days from the date of delivery the User partially or fully refuses the purchased goods, ” EKON 91″ OOD undertakes to partially or fully refund the amount deposited for their purchase within 14 days from the date on which it was informed of the User’s decision to withdraw from the contract.
11.5. ” EKON 91″ Ltd. will make the refund using the same payment method used by the User in the initial transaction, unless the User has explicitly agreed to another method of refund.
11.6. ” EKON 91″ Ltd. may withhold the refund of the payment until it receives the goods back or proof that the User has sent them back, depending on which of the two events occurred earlier.
11.7. In the event that the User does not exercise his right to withdraw from the purchased goods or services within the aforementioned period, ” EKON 91″ Ltd. automatically transforms the deposit as payment for the value of the ordered goods or services.
11.8. The right of withdrawal does not apply to:
- Goods made to the User’s specification or clearly personalized;
- Goods which, due to their nature, may deteriorate in quality or have a short shelf life;
- Sealed goods that have been unsealed after delivery and cannot be returned for reasons related to hygiene or health protection;
- Goods which, after delivery and due to their nature, have become mixed with other goods from which they cannot be separated.
12. Warranty and complaints
12.1. With each order of goods subject to warranty service, ” EKON 91″ Ltd. issues and provides the User with a proper warranty card with data on the goods and the warranty periods, as well as all the conditions of the provided commercial warranty.
12.2. The consumer cannot invoke and loses his rights under the provided Commercial Guarantee:
- In case of a lost warranty card;
- In case of damage caused by improper operation;
- In case of violation of the physical integrity of the product;
- In the event of chemical, electrical and/or other impact unrelated to the normal operation of the product.
12.3. To file a complaint about a purchased item, the User must contact ” EKON 91″ Ltd. by phone +359 82 594 914 or by email online@fortunapaints.bg and provide information about the purchased item, the nature of the complaint and contact details.
12.4. Complaints about purchased goods are accepted only upon presentation of a purchase document (receipt, invoice) and a warranty card, if the goods are subject to warranty service.

13. Limitations of liability
13.1. The products and services listed on this Site are limited only to the General Terms and Conditions and information listed on the Site, without providing any warranties beyond those specified, including commercial and purpose.
13.2. The obligations of ” EKON 91″ Ltd. with respect to the products and services offered on this Site are regulated by the relevant agreements with the importers and/or manufacturers of the products presented.
13.3. ” EKON 91″ Ltd. is not responsible for:
- Failure to fulfill its obligations under these General Terms and Conditions, in the event of force majeure, random events, problems in the global Internet network and in the provision of services beyond the control of ” EKON 91″ Ltd.;
- Damage caused by improper use of the goods;
- Failure to fulfill an order in cases where the User has provided false, incomplete and/or inaccurate personal data, including when he has provided an incomplete, inaccurate or fictitious address.
14. Protection of personal data
14.1. The protection of the User’s personal data is of paramount importance to ” EKON 91″ Ltd. Information on how the Users’ personal data is collected, processed and stored is provided in the Personal Data Protection Policy published on the Site.
15. Use of cookies
15.1. The site fortunapaints.com uses cookies to improve the user experience. Information on how cookies are used is provided in the Cookie Policy published on the Site.
16. Communication
16.1. All messages and notifications between the parties will be considered validly sent if they are sent to the addresses specified in these General Terms and Conditions or to the contact details provided by the User upon registration or order.
16.2. ” EKON 91″ Ltd. may send messages and notifications to the User via email, SMS, phone call or letter sent to the contact details provided by the User.
17. Changes to the General Terms and Conditions
17.1. ” EKON 91″ Ltd. reserves the right to change, supplement or replace parts of these General Terms and Conditions at any time, without prior notice.
17.2. Changes to the General Terms and Conditions shall enter into force from the moment of their publication on the Site. The User undertakes to periodically check for updates to the General Terms and Conditions.
17.3. Using the Site after the publication of changes to the General Terms and Conditions means that the User has accepted and agreed to the changes.
18. Applicable law and dispute resolution
18.1. For all issues not settled in these General Terms and Conditions, the provisions of the current Bulgarian legislation shall apply.
18.2. All disputes between the parties arising in connection with the implementation or interpretation of these General Terms and Conditions will be resolved through negotiations and mutual concessions, and when this proves impossible – by the competent Bulgarian court.
18.3. Consumers also have the opportunity to resolve the dispute through the European Commission’s online dispute resolution platform, available at: https://ec.europa.eu/consumers/odr/
19. Final provisions
19.1. These General Terms and Conditions shall enter into force for all Users from the date of their publication on the Site.
19.2. In the event that any provision of these General Terms and Conditions is declared invalid or unenforceable, this will not affect the validity or enforceability of the remaining provisions.
